Hockey Canada trial verdict: Five junior team players found not guilty in 2018 encounter

Five non -guilty sexual assault players have been found in a case involving members of the 2018 World Hockey Team.

Carroccia stated that he did not find that the victim’s tests were “credible or reliable” when reading the verdict.

“After finding that I cannot trust the EM Tests and then considering the tests in this process as a whole, he concludes that the crown cannot find any of the counts in front of me,” Carroccia said.

Mcleod, Hart, Formenton, Dube and Foote had declared themselves to be guilty of sexual assault related to an incident that took place in a room in London, Ontario, the hotel on July 19, 2018. Mcleod was the only defendant charged with two crimes and was not guilty of both charges. He was also accused of “being a party for crime.”

Carroccia classified the various accounts of the encounters between Mcleod and the victim as “confusing”. The judge mentioned Mcleod’s changing stories, but he did not believe that it was enough to not believe the portions of his tale of evening events.

Mcleod was portrayed as “architect” by prosecutors throughout the trial.

During the trial, it was revealed that Mcleod met the victim at a bar in London before the night before inviting -in his hotel room. The prosecutors claimed that Mcleod brought several friends to the room in order to perform sexual acts with the victim without his consent.

The woman testified that she did not voluntarily consent to the sexual events that took place in the hotel room. The defense team, meanwhile, argued that the woman voluntarily participated in sexual acts and created a false story about what happened throughout the trial.

Lawyers representing Mcleod, Hart, Formenton and Dube argued that the woman had given their consent to sexual acts, while Foote’s lawyer stated that he was dressed while being forex on his body during the alleged assault.

Two other team members, Brett Howden and Tyler Steenbergen, testified that the woman asked the group if anyone would have sex with her. In total, nine witnesses testified during the six -week trial, with the majority they gave their accounts remotely.

The trial began in April and was heard by a jury. However, Carroccia unloaded the panel twice and finally changed to a lone judge to avoid having to start the trial again.
